Terms and Conditions Free Travellers

Your holidays are very important to you and extremely important to us!

Please read carefully the booking Terms and Conditions that form the basis of your contract, and rule the use of this site and its available content provided therein and are applied to all travel supplied provided by Free Travellers.
Once you book you trip you agree to the following Terms and Conditions:

 

1. Contract

The present Conditions apply to all bookings made with Free Travellers. By booking a trip with us you are deemed to have agreed to these booking which constitute the entire agreement between you and us and your booking will be accepted by us on these basis. The services provided are those referred on the booking confirmation and travel documents.

 

2. Organization

The travel organizer is specified in each program presented.
Free Travellers is a brand under the commercial liability of Novas Ideias Turismo, Rua General Farinha Beirão nr. 2, 1169-146 Lisboa – Portugal. l Capital Social € 200,000.00, registered at the Commercial Registry Office of Lisbon under the number 4737 |NIF 503189948 | RNAVT No. 2135.

 

3. Booking and Refunds

You are required to pay a non-refundable deposit of 40% of the total value of the trip per person for your booking to be confirmed (in some cases the deposit may be higher). If your booking is made within 30 days or less of departure date, the full amount must be paid at the time of booking. The travel agency reserves the right to cancel the reservation if the deposit has not been made under such conditions. Whenever any of the airlines involved in the program needs the immediate issue or set a deadline for issuing the tickets the customer will be informed of the relevant amount to be paid.

 

4. Booking Confirmation and final payment

Confirmation of your booking will be sent in writing as well as payment details. Total amount of reservations due 30 days prior to departure or 60 days in case of cruises or special programs. If the balance is not paid on or before the due date we reserve the right to consider your booking cancelled.

 

5. Your data

In order to confirm your travel you must provide all necessary information: full name as per passport, date of birth, nationality, passport number, passport issue and expiration date.

 

6. Last Minute Booking

Reservations or additional services requested within 15 days prior to departure, depending on the program and supplier, may be subject to an additional service fee.

 

7. Prices and surcharges

Our prices were based on currency exchange rates on the date the program was printed. Prices can be modified in case of increases in airfare, fuel costs, fees and taxes for certain services, as well as currency exchange changes. Any change in value may originate the revision of the final price of the trip. In such circumstances the Customer will be informed in writing, and may, if the increase is significant, give up the journey without penalty and shall notify the agency within four days. The price will not be increased in the twenty-days preceding the date of the beginning of the trip, for reservations already made, except taxes, which may be modified until tickets issuance.
The price includes:
Accommodation as indicated in the confirmation, all transport indicated in the itinerary, sightseeing and meals as indicated in travel notes, Fees, taxes and VAT, when applicable, guide assistance during the trip when indicated, services and add-ons listed in the itinerary.
The price does not includes:
International flights, internal flights, transfers to and from the airport unless stated, excess baggage fees, visas, airport taxes or local fees, vaccinations, meals not specified, extras, like drinks, hotel optional services, local visits and gratuity not indicated and, in general, any service not listed as included. Eco fees or local taxes in protected areas whose purpose will be to preserve the environment will be paid locally by the Client.
Cruises: Tips are mandatory, customer will be informed of the amount to be paid. The amount will be determined according to the length of the cruise and is not subject to any promotional discount and is subject to change without notice.
Snow Travel: Unless otherwise indicated in the program ski pass or ski courses are not included. Optional activities not included in the itinerary are not part of this contract. We are not responsible for any activity purchased from the local representative

 

8. Cancellation by the Traveller

The Traveller may cancel the trip anytime communicating its decision in writing. Handling and cancellation fees will be deducted from the sum already paid according to the cancellation policy. If cancellation occurs within 30 days before departure the cancellation fee is 15% of total trip; between 29 and 15 days prior to departure 25%; between 14 and 3 three days before departure 75%, and 100% 48 eight hours prior to departure or in case of no show. Cancellation fees may vary according to the characteristic of each trip and supplier. If you leave a trip for any reason after it has started we will not refund any amount for unused services.
Cruises: Any time €250 non-refundable; cancellation 180 days or more prior to trip date 550€; between 179 and 90 days prior to travel 50% of the total amount; between 89 and 60 days before travel and 75%, between 59 and 0 days prior to travel 100% of the total cost.
Exclusive Tour: Any time the value of the initial deposit is non-refundable; cancellation between 269 and 210 days prior to departure 25% of the trip cost; between the 209 and 150 days prior to trip date 59% of the trip cost; between 149 and 120 days 75% of the trip cost, between 119 and 0 days prior to departure 100% of the trip cost.
Snow packages: Any time the value of the initial deposit is non-refundable. Between 59 and 30 days before departure 50% of the trip cost; less than 30 days 100% of the trip cost.
Flights: Different fees may apply to airline tickets depending on the carrier being used.

 

9. Cancellation by Free Travellers

Our trips are guaranteed with a minimum of four participants paid in full, unless otherwise specified in each itinerary. Should the trip be cancelled for not reaching the minimum number of participants you are entitled only to reimbursement of the amount paid or anticipated values, without being able to claim any amount as compensation whenever the Agency has notified in writing with at least twenty days before the departure date. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events, it is not viable for us to operate the planned. If we cancel a trip you may choose between an alternative trip with a possible price increase or cancel receiving a full refund. The Customer shall notify its decision within four days of being informed: If you do not communicate your decision within the established period we presume your travel is cancelled and will be entitled to a full refund. Free Travellers is not responsible for any expense incurred as a result of booking such as visas, vaccinations or non-refundable flights.

 

10. Booking Amendments

If you wish to transfer your trip to another program or transfer your booking to a third person, you must notify us in writing 40 days before the trip. In both cases the change is subject to acceptance of specific conditions of different service providers. The transfer to a new program will only be permitted to a departure date within the current validity period and the transfer to a third party will only be permitted provided that the new passenger meets all the conditions required for the trip. No amendments are permitted to your booking within 10 days of departure. *Inca Trails bookings cannot be transferred without full loss of deposit.

 

11. Changes of itinerary

While we endeavour to operate all trips as described we may modify the order of the itinerary, schedules, routes, hotels, and transport, without prior notice due to local circumstances or events.
Before departure: If unforeseen circumstances force them to suspend any services and the organizer is forced to significantly change any element of the agreement, you will be informed being entitled to the refund of travel.
The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change obtaining a full refund of all monies paid or accepting an alternative tour offered.
After departure: We reserve the right to change an itinerary after departure due to local circumstances or reasons beyond our control. In such case, the additional costs of any necessary itinerary changes will be covered by you.
Please refer to the trip notes of your itinerary.

 

12. Documents

You must carry all personal and family updated documents (passport with more than 6 months from date of travel, the citizen card, identity, authorizations for minors, visas, certificates of vaccines, etc.). Please read the information in the notes of your travel program. Free Travellers is not responsible if you are refused entry into a foreign country for lack of the required documents, and of any expenses resulting therefrom. It is your responsibility to ensure that you are in possession of the current visas, permits and certificates for your trip. To travel in the European Union, and in order to obtain medical assistance it is also recommended to hold an European Health Insurance Card.

 

13. Travel insurance

Travel insurance is compulsory for all Free Travellers programs and should be taken out at the time of booking to protect from any incident that might occur during the trip and ensure the continuing assistance, subject to any additional safe transportation companies involved in trip. See the coverage described in the policy conditions.

 

14. Accommodation on Board (Cruises)

The organizer can assign a different cabin from the one set in the contract, as long as it has similar characteristics. When a change into a cabin with a lower price occurs passengers affected will be entitled to a refund of the price difference according to the rate in the catalogue. Captain’s Powers: According to international navigation rules, the captain has full powers to: Towing or assist other vessels in any circumstances, deviate from the original route, change any port (whether or it is in the ship’s itinerary), transfer passengers and their luggage to another vessel for onward journey, to refuse boarding to anyone who is not in your judgment or health conditions that permit the continued trip or cause damage to other passengers. The passenger had been subject to rules adopted by the master in everything that relates to safety on board, the exercise of powers relating to the preceding paragraph and any other derived from international standards, the rules governing navigation and circumstances imposed by the conditions weather. Breakdowns and conflicts cannot be considered breaches of this contract.

 

15. Authority on Tour

The scheduled group trips and guided by a tour leader, the decision of the group leader is final on all matters likely to affect the welfare and safety of all participants in the trip. If you don’t not respect the decisions made by the tour leader related to the safety or interfere with the welfare of the group the group leader may order you to leave the trip immediately. In these Circumstances there will be no refund. All participants must comply with the laws, drug regulations, customs, of all countries visited. You also agree to travel in accordance with our responsible travel guidelines

 

16. Child conditions

Given the diversity in treatment applicable to children, and depending on their age and the service provider we recommend you to consult the special conditions, and that will be informed upon the confirmation of the trip.

 

17.Claims and Complaints

In case you have any complaints during your trip, inform your guide or our local representative at the time, in order that they can rectify the matter.
If satisfaction is not reached through these means then any future complain should be put in put in writing to us within 30 days of the end of the tour.

 

18. Acceptance of risk

You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you assume the personal risks associated upon such travel.

 

19. Errors and Omissions

Although we have made a detailed study to verify the accuracy of statements on our travel documentation, including Website programs and Travel Notes, we cannot be held responsible for any error, omission or unintentional misrepresentation that may have occurred.

 

20. Limitation of liability

We contract with a network of companies, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:

– Any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded;
– You release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip;
– Any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.

 

21. Applicable law

The above terms and condition are governed by Portuguese Law, all disputes arising from the application of this contract shall be submitted to the district court of Lisbon.
